Martha Jane Johnson was born on 6 July 1821, daughter of Austin Johnson and Ann Elizabeth Corley, in Sumner County, Tennessee.2
Martha Jane Johnson, 16, married James H. Turner, son of John (L) Turner and Elizabeth Bailey, on 5 October 1837 in Sumner County, Tennessee.1,3,4
On 20 February 1841, in the Circuit Court Feb Term 1848, Martha Turner, exparte petition for division, set off to her her dower out of the real estate of James H. Turner, her dec'd husband. Land is on the waters of Bledsoe Creek, containing 60 acres. Commissioners: James Bryson, Jacob Gilespie, Peter Bryson, Francis Rogan and Isaac P. Parker. Registered 14 May 1848 at Sumner County, Tennessee.5
Martha Jane Johnson and Enoch Simpson obtained a marriage bond on 20 March 1841 in Sumner County, Tennessee, with Austin Johnson, presumably a relative, as bondsman.6
Martha Jane Johnson, 19, married Enoch Simpson, son of Aaron Simpson and Charlotte Wisheart, on 21 March 1841 in Sumner County, Tennessee. The marriage took place six months after her husband, James H. Turner, died.1,6,7
Between 1848 and 1849, a case in Chancery Court was brought between Enoch Simpson (Martha's husband) and Nelson B. Turner over the guardianship of John Turner, Nelson's nephew, which ran over a period of two years.
A number of depositions were taken from family members. On 6 Apr 1849, Elizabeth Turner Buntin, about 50 years of age, testified that Martha Johnson Turner Simpson wanted Nelson to have management of her son's estate and that her father should not have his hands on it. She further testified that Martha remarried only six months or so after James' death.
Benjamin Johnson, married to Nelson and James' sister, Rebecca testified that he had known Nelson Bailey Turner for about thirty years and Mr. Simpson some ten or twelve years. He'd known Martha Turner Simpson for about twenty-six or twenty-seven years. He testified to the friendship between Nelson and his brother, James. He did hear James call for his son as he lay dying, but when Martha turned to get the child, she was stopped by Rebecca and Elizabeth Buntin (his sisters). He further testified that the best interest of the child would be served by Nelson B. Turner.
James Gwin (who lived about a half mile from Enoch Simpson) testified that Simpson had said that if John (James' son) went to the Turner's (Nelson's) house, he could not "stay at his house." When asked who would do more to promote the interest of the child, he was confident of Mrs. Simpson, but "can't say as to Mr. Simpson."
Thomas J. Flowers (married to a cousin of Mrs. Simpson - it is believed Martha Ann John was born c1816, but her parentage is unsure, and married Thomas Jefferson Flowers on 5 May 1838) testified that he had known Enoch Simpson for some six years and Mrs. Simpson for ten or eleven years. I lives near the Simpsons and done business with him and Gwin. He stated he had seen Mr. Simpson drink more freely than was good for him and at one time he did use vulgar language. He stated he had known Nelson B. Turner for about twenty years, believes that a child could be better educated at the Turner's. He did say that he had never seen Nelson drink too much, but they had shared liquor occasionally.
Susanna Johnson (James' and Nelson's sister) testified "We (she and her mother) stopped at Mr. Simpson & asked Aunt Martha to let John to go home with us. She said he mite go and he started with us & she called to stop & said she reckoned he had better not go & said that without Mr. Simpson were there, he mite not like it if he went & John were very anxious to go & cried when his mother told him to get out of the buggy." She further stated that she had not seen him at her father's until this week, that the distance from her father's to Nelson's place was about twelve miles, and that she had attended parties at his house where they played cards and danced. (I don't have a Susanna Johnson as a sister to James and Nelson Bailey Turner. Francis, their sister, was married to Richard Collins Johnson.)
James Gwin testified to opposing counsel that he was well acquainted with both parties and their neighborhoods, pointing out that Mr. Turner lives about 1 mile and 3/4 from Mount Zion whereas Mr. Simpson is about three 1/2 miles. Furthermore, he had a preference for the neighborhood of that of the Turner family. In answer to the question "Please state from your acquaintance with Mr. Simpson and family is behind the times and the customs and fashions of the territory if so how far?" He replied "Some twenty or twenty five years and a considerable portion of his neighborhood and associates are also in the same condition. Mr. Simpson and myself were partners in a mill for several years." When asked if Mr. Simpson was a stubborn man in his disposition, he said that he was. However, he said he would be unpleasant, but not ungrateful, for the mother of the child for him to be removed. The child would find it unpleasant. He commented that the N.B. Turner family occupied the middle or medium ground in society, that the times are much better now than twenty to twenty-five years ago, and that Mr. Simpson's children are very limited in their education.
William Johnson testified to an encounter between himself, Jo. D. Turner and Mr. Simpson:"Jo D. Turner and myself were at the camp meeting at the Dry Fork. Mrs. Simpson invited us to go home with her to dinner. We went sometime after dinner. Jo D. were walking the floor and had or had John in his arms. Mrs. Simpson were sitting in the room. Jo D. had on a new pair pants with buttons on from the ankles near the knees. Mrs. Simpson took hold of one of the buttons and said she would cut one off or pull it off. Jo D. took hold of her "yeore" [no idea what this means] and shuck it and turned off. Mr. Simpson came out of the piaser [pisser?] & took Jo D. by the arm & pointed to the door. Jo D. asked him what he had done. Mr. Simpson said he did not want to have any words about it but if he did not get out, he would put him out. Mrs. Simpson spoke and said Mr. Simpson we always fooled & played in Mr. Turners life time & meant no harm. Mr. Simpson said, I don't know what you come for, for you was not wanted when you were fetched. Jo D. then got his horse and left. I then left the house until Mr. Bradley & Mr. McGlothlin had left. I then returned to the house & found Mr. Simpson & his wife quarreling about the way Mr. Simpson had treated her & Jo D. I cannot remember all that was said but what I do remember, I remember that Mrs. Simpson told Mr. Simpson that if he didn't mind how he talked & went on that she would not stay with him but would go back to the old place. Mr. Simpson told her that if she wanted to go she could go. Mrs. Simpson threw up some woman on the north side of the ridge to Mr. Simpson, he then threw up Mark Moore & Jo D. Turner to her. She then told him that she loved Mark Moores little finger better than she did his whole body, in run of the conversation Sanford Simpson, the son of Enoch Simpson, gave Martha Simpson the boy." He then stated his relationship: my mother and N. B. Turner were brother and sister; my father and Mrs. Simpson's father were brothers. "I am well acquainted with the parties the friendship were very good between the two Turner families and the children of N. B. Turner. Aunt Martha were all ways playful in the life time of James."
John T. Carter testified that he went with N. B. Turner to the north side of the ridge to Sanford Simpson to demand "John the ward & told Sanford that he thought as he were his guardian he had the right of selecting the place for the child to go to school at. Sanford told him that the boy should not go without the consent of his mother. Turner told Sanford he would take the boy to his mother he would go and see her about him. Sanford promised to send him back. Subsequently, Sanford stated the boy were brought there [to him] for his accommodation to go to school with his son. He further testified that the school house in is Trouts district, was very sorry and even the neighborhood is uniformed, quite dissipated, and that Sanford's children had very limited education. He stated the character of the schools is much better in N. B. Turner's neighborhood.
Richard Bradley testified about the above incident, telling it much the same way. After Jo D. Turner had left, he stated "Mrs. Simpson appeared to be vary much hurt and said she were sorry that he had treated the boy the way he had and said that Mr. Turner always had thought a great deal of the children & especially of Jo D."
Benjamin Johnson, age 50, testified that he had known Martha since she was born, that he was present at James Turner's death bed, but that James and his wife spoke together briefly, but he did not hear the conversation. "I think there was a coolness between James H. Turner & Thomas Buntin in consequence of a law suit about the old man Turners mill. I have been acquainted with Mr. Nelson B. Turner for some 35 to 40 years, his character stands in my estimation as far as any man. The neighborhood he lives in stands in point of morality, as far as any of my knowledge. I was told by some of Wm. Carters family that N. B. Turner was sending his children to the Dry Fork school house or some school in that neighborhood." When asked about the relationship between N. B. and James H., he said: "They visited each other frequently. There was a good intimacy between them. James H. would always advise with N. B. Turner in almost any undertaking, in buying stock on a farming matter & etc. I believe he had more confidence in N. B. Turner than any other man, and from the confidence he had in N. B. turner, I think he would preferred him to attend to his matter to that of any other man. I was at the sale of Jas. H. Turner and I think of the bids of Martha, James H. Turners wife, that she showed a deposition to purchase the property for less than its value. I asked N. B. Turner whether it was right for her to buy this property so low or not. I do not now recollect his answer. I heard N. B> turner say to Martha that she ought to bid a fair price for the property or something near worth, as she would wrong the child out of it just right in buying the property for less than its true value. . . . . The child of Jas. H. Turner has not been with his father's connection much since Martha, Jas. H. Turners wife, married Enoch Simpson. . . . I would prefer a child of mine being place in that (N. B. Turner's) neighborhood."
Martha A Flowers, about 30, testified that her mother and Martha's father were brother and sister and that she lived near them for about fifteen months. She further reported that Mrs. Simpson frequently said that Mr. Simpson was unwilling for John to go to N. B. Turner's house which was why she was unwilling. Ms. Flowers further stated that she had heard Mr. Simpson use vulgar language and that he mortified his wife on occasion. She told the same story about Jo D. Turner, adding "Mrs. Simpson further stated that she were vary sorry that the occurrence happen that she meant no harm, and did not believe that Jo D. Turner meant any either. Mrs. Simpson further stated that she went in the woods and thought she would have stayed there until she died. She stated that the education of the child would be better served with N. B. Turner. In response to questioning by Enoch Simpson, she testified that she had heard Mrs. Simpson say that she was unwilling to give up the raising of her son to any person. As to N. B. Turner, she was afraid he would learn bad words and might be killed by riding a horse."1

Richard Johnson was born circa 1760 in Hanover County, Virginia Colony, because he is listed as 80 years of age on the list of pensioners for Revolutionary or military service in the 1840 census.2,3
He also is reported to have been born in 1758.4
He performed his Military Service in May 1777 when he entered service from Hanover County, Virginia for seven weeks in Capt. Robert Dabney's militia company in the regiment commanded by Col. In 1778, he again entered the militia for three months from Hanover County in the regiment commanded by Col. Flemming and Major Robert Dandridge in Capt. John Anderson's company. He march from Hanover County through the city of Richmond, James City and Charles City and was stationed at Cabin Point in Surrey County, Virginia.
He was next 'pressed' by Capt. James Waller in July 1779, one of the commissioners of the Army of the United States, and served for three months after which he was discharged at Meadow (?) Bridges in Virginia.
